If you and your spouse can reach an agreement on the issues, the answer is YES.  In fact, your divorce is usually finalized about 30 days from the day the case is filed.  All divorces are finalized when the judge assigned to your case signs a final judgment of dissolution.  That usually occurs at a very short final hearing (about 3 minutes) at your local courthouse, at which point you may or may not have to attend with your Florida online divorce attorney.

What to Expect During an Online Divorce in Florida?

Although the hearing is about 3 minutes, travel + parking +waiting + missed time from work = lost time and money.  If there are no children involved, NO COURT hearing is required.  If there are children, our Florida child support attorney offers, but does not recommend, the “no-hearing” option and here’s why:  if there is a child related issue after the final judgment is entered – failure to pay child support, failure to follow the parenting plan, anything having to do with the children that requires a return to court, you would need to pursue that matter where the case was filed (probably not where you reside) or transfer the case back to the county where you reside.

Both of those are doable; however, we do not want you to incur any unnecessary costs/fees and therefore recommend against the no-hearing option when children are involved.  That said, be wary of Florida online divorce lawyers who recommend that option – not a good idea.  The hearing is short and sweet and if you get to court about 15 minutes before the designated hearing time, you should get in and out inside of 30 minutes.

What is the Online Divorce Process in Florida?

So, what is an online divorce?  When we started this web site, our goal was simple:  provide cost effective representation and get our clients’ the Florida family law attorney services required to resolve without much fanfare and as quickly as possible – uncontested divorces within 30 days of filing.  Why 30 days?  Because the court must wait at least 20 days from filing to enter a final judgment.  So, between filing, mailing, waiting for judge to sign final judgment, 30 days is about what it takes but it could be a few days less or more.

We offer online meetings by video conference should you so desire; many of our clients take advantage of this – nothing to install – we will send link to conference and we’ll be “together.” We take all required information during our initial meeting whether by video or phone. If you don’t have all necessary information, no problem – call, email or fax- whatever is easiest for you.  Once we have all required information about you, your family, property, etc., we will prepare all required documents (usually within 2 days) including, but not limited to, marital settlement agreement and child support guidelines, and get them to you by email or fax – your choice. On rare occasions, we use the good old U.S. mail.

If there are children involved, we will need financial affidavits and parenting plan to complete our work. Don’t worry – we will send them to you. When you receive the documents, you will review and if all is in order, print, sign, notarize and return via email or fax. Yes, the documents and financial affidavits must be notarized. Can you do that online?  Yes, we can arrange to have all documents notarized online; two requirements, you must be in Florida at the time and must have a valid photo identification. There is an additional cost for online notary service.

Once your Florida online divorce attorney receives all required and properly executed documents, your case will be electronically filed and final judgment entered about 30 days later.  Final hearing, if required, will be set about 20-30 days after case is filed.  If hearing is required, court rules allow for Florida online divorce lawyers to appear via phone.  To keep fees to a minimum, we use all court rules to the advantage of our clients.  At the hearing, either myself or the judge will ask you about 6 questions (name, rank and serial number stuff) and the judge will sign and give you a copy of the final judgment before you leave.  Remember, if you have kids, we offer the no-hearing option but do not recommend.
